Legal Drug Testing in the workplace. There are five times that it is legal to drug test your employees in the workplace. These times are tested through the Supreme court, but MUST be represented in your policy and procedure manual in order for you to enact them.
#5 Random Drug Testing
There are only 3 times that Random Drug testing is and option... If the employee drives for you and are on your auto insurance, you can random drug test. If the employee operates dangerous machinery for you than you can random drug them. If the employee is involved in public safety has access to drugs, cash handling, or works with the youth or elderly...

#4 Reasonable Suspicion
There is no Federal mandate on how to handle Reasonable suspicion, but it is a good business practice to have at least two people look at the employee and think that they are on drugs or alcohol. If this meets your policies, you are fully able to take this employee to the hospital for a drug test immediately.

When the Policy Changes...

When you make updates and addendums to your business policy and procedure book, you must have your current employees sign ANOTHER acknowledgement page. This page will cover you for the changes in policies and proves that you alerted your employees of that change. This is a important step for your organization to protect itself from employee law suits. Keep all signed acknowledgement pages in your employee files until the employee has terminated with your company and through the safe keeping period.

Always have them Sign the Dotted Line...

Remember, as it relates to your policies and procedures manual, it does not exist to your employees, if you do not have them sign an acknowledgement page. This sheet just acknowledges that your employee had the opportunity to view the company policies and procedures. It doesn't state that they agree with them, just that they are aware they exist. This has to be a prerequisite for working with your organization. If the employee does not sign, in a legal preceding they could simply state that they were not aware of the rule they violated. How do you prove they were aware? This signed form should stay on file for as long as you have paperwork on the employee.
